Terms and conditions
This is a translation. If the language versions differ, the Polish version prevails.
These terms set out how buying at jollyheap.com and using the website work. They do not limit any rights you have by law: where a clause conflicts with mandatory law, the law applies.
§ 1. General provisions
1.1.The online shop at jollyheap.com is operated by “JOLLY-HEAP” Svitlana Sapunova, Aleja Led 4, 55-020 Rzeplin, Poland, NIP (Polish tax number) 8992772832, REGON 362440030, entered in the Polish Central Register and Information on Economic Activity (CEIDG) (the “Seller”). Contact: info@jollyheap.com, phone +48 71 880 87 27.
1.2.The Seller is party to every sales contract concluded here and the controller of the personal data buyers provide in their orders.
1.3.Nothing in these terms limits or excludes the rights of consumers, or of natural persons entering into a contract directly connected with their business where the contract is not of a professional nature for them (a “quasi-consumer” under Polish law). Doubts are resolved in favour of those buyers, and any clause conflicting with mandatory law is void.
§ 2. Prices and VAT
2.1.Prices shown in the shop are gross prices (they include Polish VAT at 23%) and exclude delivery, which is stated before you place the order and in the order summary.
2.2.Our prices are set in euros. Prices in Polish złoty and in US dollars are converted from the euro prices at the average exchange rate of the National Bank of Poland, updated daily. The price in the currency shown in the order summary at the time of ordering is binding.
2.3.For delivery to a country outside the European Union the sale is an export taxed at 0%, so the price in the order summary does not include VAT. The country of destination may charge customs duty, import tax or clearance fees; these are not part of the price and are collected by the carrier or the customs office.
2.4.A business from another EU Member State that enters a valid EU VAT number in the order, confirmed in the VIES system, buys as an intra-Community supply of goods taxed at 0%, so the price in the order summary does not include VAT. The buyer is responsible for the accuracy of the number given.
2.5.Whenever a price reduction is announced, the Seller also states the lowest price of that product in the 30 days before the reduction, or, if the product has been offered for less than 30 days, the lowest price since it was first offered.
2.6.The volume discount calculated automatically from the number of blocks ordered is not an announced price reduction; it is a contractual term depending on order size.
§ 3. Conclusion of the contract
3.1.Product information in the shop, including prices and descriptions, is an invitation to treat, not an offer.
3.2.Placing an order is your offer to buy. The button completing the order is labelled “Order with obligation to pay”.
3.3.The contract is concluded when you receive confirmation that the order has been accepted. The Seller sends it no later than 5 business days after the order is placed; after that period the offer ceases to bind.
3.4.The confirmation is sent to the e-mail address given in the order and contains the contract terms and these terms on a durable medium.
3.5.No account registration is required.
3.6.Failure to pay within 5 business days of placing the order is treated as withdrawal of the offer, unless the parties have agreed on a different payment term.
§ 4. Right of withdrawal
4.1.A buyer who is a consumer or quasi-consumer may withdraw from the contract without giving a reason within 14 days of taking possession of the goods, personally or through a third party other than the carrier. For orders of several items delivered separately, in lots or in parts, the period runs from taking possession of the last item, lot or part.
4.2.It is enough to send the withdrawal statement to info@jollyheap.com before the deadline. You may use the model withdrawal form, available together with the instructions on the Right of withdrawal page (also as a PDF), but you do not have to. You can also withdraw online, using the “Withdraw from contract here” form on the same page (a button with this label is in the footer of every page); the Seller then immediately emails an acknowledgement of receipt with the content of the statement and the date and time it was submitted.
4.3.Because of the size of the sets, the goods are collected from you by a carrier appointed by the Seller: once you have made your statement, the Seller tells you the cost of return and arranges a collection date. You may also send the goods back to the Seller’s address yourself, without undue delay and no later than 14 days after withdrawal.
4.4.You bear the direct cost of returning the goods. Within the European Union it is about €30 for every 100 blocks; for shipments from other countries the Seller states the cost before collection. Details are on the Shipping and returns page.
4.5.You are liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning. Handling the goods as you would in a shop neither removes your right of withdrawal nor delays the refund.
4.6.The Seller refunds all payments received, including the cost of delivery to you (except additional costs arising from a delivery method other than the cheapest standard one offered by the Seller), without undue delay and no later than 14 days after receiving the withdrawal statement.
4.7.The refund uses the same payment method you used, unless you expressly agree to another method that costs you nothing.
4.8.There is no right of withdrawal in the cases listed in Art. 38 of the Polish Consumer Rights Act, in particular where the goods are made to your specification or clearly personalised. If an order is of that kind, the Seller says so before you place it.
4.9.This section does not apply to buyers other than consumers and quasi-consumers.
§ 5. Payments
5.1.You can pay by card, Revolut Pay, Apple Pay or Google Pay (the payment service provider is Revolut) or by bank transfer to the Seller’s account, the details of which are given after the order is placed (on screen or by e-mail).
5.2.The day of payment is the day the Seller’s account is credited or the day a positive authorisation is confirmed by the payment service provider, whichever comes first.
5.3.The Seller may accept another form of payment by individual arrangement, in particular for institutions financed from public funds.
§ 6. Fulfilment and delivery
6.1.The Seller starts fulfilment once payment is received or, where deferred payment was agreed, once the order is accepted.
6.2.Delivery time: up to 7 days in Poland and in European Union countries and 10–14 days outside the European Union, counted from the day the payment is credited or, with deferred payment, from acceptance of the order.
6.3.In every case the Seller delivers the goods no later than 30 days from conclusion of the contract. If the Seller misses the deadline, you may set an additional period and, if that too passes, withdraw from the contract.
6.4.The delivery cost depends on the country of delivery and the size of the parcel. The current price list is on the Shipping and returns page, and the exact amount is shown in the cart and in the order summary before you place the order. Delivery to countries not on the price list is quoted individually before the order is placed.
6.5.An order containing goods with different availability dates ships once complete, unless agreed otherwise.
6.6.For a consumer, the risk of accidental loss or damage passes when the carrier hands the goods over.
§ 7. Invoices
7.1.The Seller issues a sales document for every order.
7.2.Invoices for business buyers are issued as structured invoices in the Polish National e-Invoicing System (KSeF), as required by law. The buyer additionally receives a visualisation of the invoice by e-mail.
7.3.A consumer receives an invoice on request, electronically to the e-mail address given or on paper with the shipment.
§ 8. Goods not in conformity with the contract
8.1.The Seller is liable to consumers and quasi-consumers for lack of conformity with the contract existing at the time of delivery and revealed within two years of that moment. A lack of conformity revealed in that period is presumed to have existed at delivery.
8.2.You may request repair or replacement. The Seller repairs or replaces within a reasonable time, without significant inconvenience and at its own cost, including the cost of returning the goods.
8.3.You may declare a price reduction or withdrawal from the contract where the Seller refused repair and replacement or failed to bring the goods into conformity, where the lack of conformity persists despite an attempt to remove it, where it is serious enough to justify withdrawal without first requesting repair, or where it is clear the Seller will not bring the goods into conformity within a reasonable time or without significant inconvenience. You cannot withdraw if the lack of conformity is immaterial.
8.4.You may withhold payment of the price until the Seller has performed its obligations arising from the lack of conformity.
8.5.Send complaints to info@jollyheap.com, describing the problem and what you are asking for. The Seller replies within 14 days; no reply within that period counts as accepting the complaint.
8.6.Goods not in conformity travel back at the Seller’s cost to its registered address, once the method of collection has been agreed, as some sets are too bulky for an ordinary parcel.
8.7.The Seller is not liable for a missing characteristic where you were expressly informed that a specific characteristic departs from the conformity requirements and you expressly and separately accepted it no later than when the contract was concluded.
8.8.Towards buyers other than consumers and quasi-consumers, the Seller’s statutory warranty liability is excluded.
§ 9. Guarantee
9.1.Independently of the liability described in § 8, the Seller grants a quality guarantee for 3 years from delivery of the goods, and for 10 years on the magnets sealed inside the blocks.
9.2.The guarantee covers material and workmanship defects revealed in use consistent with the intended purpose. It does not cover normal wear, mechanical damage occurring after delivery, or the effects of washing contrary to the care instructions.
9.3.Guarantee claims are settled by repairing or replacing the defective element. Guarantee claims can be sent to info@jollyheap.com. The guarantee applies within the European Economic Area.
9.4.The guarantee neither excludes, limits nor suspends rights arising from the rules on conformity with the contract.
§ 10. Product safety
10.1.The manufacturer within the meaning of Regulation (EU) 2023/988 is the Seller (details in § 1.1); safety contact: info@jollyheap.com.
10.2.The goods meet the requirements of EN 71-1, EN 71-2 and EN 71-3 and carry the CE mark. Every block passes a factory X-ray check: we check that there are no foreign objects inside and that the magnets are in place.
10.3.Warnings and safety information, including the age marking, are given on each product page and on the packaging, in the language of the country of delivery.
10.4.Please report any safety incident to info@jollyheap.com. The Seller takes corrective action and fulfils its reporting duties under the applicable rules.
§ 11. Reviews
11.1.Reviews shown on the site come from institutions that bought and use the goods. The Seller collects them directly and, before publishing, checks in the order records that the author is a buyer. Unverified reviews are not published.
11.2.The Seller neither commissions nor publishes false reviews and does not edit reviews in a way that changes their meaning.
§ 12. Electronic services
12.1.Through the jollyheap.com website the Seller provides the following electronic services free of charge: access to the website content, the cart, the order form, the contact form and the distributor form.
12.2.To use the website you need a device with internet access and an up-to-date web browser with JavaScript enabled and, to place an order or send a form, an e-mail address.
12.3.The contract for access to the website content is concluded when you open the website and ends when you leave it. The contract for using the cart, the order form or the contact form is concluded when you start using them and ends when you send the form or stop using it. You may stop using the services at any time.
12.4.You must not provide unlawful content, including entering content into forms that breaks the law or infringes other people’s personal rights.
12.5.Using the internet involves risks, in particular malware and attempts to impersonate well-known companies (phishing). The Seller never asks for passwords or full card details by e-mail; card payment takes place only on the payment service provider’s secure page. If you are unsure whether a message comes from us, please contact info@jollyheap.com.
12.6.Complaints about the electronic services can be sent to info@jollyheap.com. The Seller replies within 14 days.
§ 13. Accessibility
13.1.The Seller aims to make the website and the shop meet the accessibility requirements of WCAG 2.1 level AA and the EN 301 549 standard. Information about the accessibility of the service, known limitations and how to report problems is on the Accessibility page.
§ 14. Personal data
14.1.The controller of buyers’ personal data processed in connection with an order is the Seller. Data from the contact form and the distributor form is processed jointly by the Seller and JOLLYHEAP Sp. z o.o. as joint controllers. Processing rules, legal bases, retention periods, recipients and data subject rights are set out in the Privacy policy.
14.2.Providing data is voluntary but necessary to place an order and perform the contract.
§ 15. Final provisions
15.1.Placing an order requires acceptance of these terms.

15.3.Matters not covered here are governed by Polish law, provided that this choice does not deprive a consumer of the protection of mandatory rules of their country of habitual residence.
15.4.A consumer may use out-of-court complaint and redress procedures, including mediation and arbitration. Information is available from the Polish competition authority (UOKiK) at polubowne.uokik.gov.pl. A consumer from another EU Member State may ask the European Consumer Centre in their country for help; in Poland: konsument.gov.pl.
15.5.Disputes with buyers other than consumers and quasi-consumers are settled by the court having jurisdiction over the Seller’s registered office.
15.6.The Seller may amend these terms; amendments take effect 14 days after publication. Contracts concluded before an amendment remain governed by the previous version.
15.7.These terms are available in all the languages of the website. In case of divergence, the Polish version prevails.
